This action was filed on June 10, 2022. On November 13, 2022, Counsel, Herbert Wiggins, for Plaintiff, Maria G. Hernandez, filed a motion to be relieved as counsel.  Counsel cites a breakdown in communication and requests the ex parte motion so that his current client is not prejudiced in her opposition currently set on calendar for February 14, 2024, one day prior to the current date scheduled for this hearing.  Counsel further shows harm to himself he cannot provide effective representation, as well as Plaintiff as she deserves the counsel of her choice. (See Aceves v. Superior Court (1996) 51 Cal.App.4th 584.; Cal. Rules of Court, rule 3.1202(c).)  

Accordingly, Counsel HERBERT WIGGINS’ Ex Parte Application to ADVANCE the Hearing for the Motion to be Relieved as Counsel is GRANTED.  The Motion to be Relieved as Counsel is ADVANCED from Thursday, February 15, 2024, to this date and CONTINUED to Thursday, December 21, 2023. Opposition and Reply papers to be filed and served per Code in accordance with the new hearing date.
