Cross-Defendant 1 Oak Remodeling, Inc.’s Motions in Limine
Cross-Defendant’s MIL No. 1 is
MOOT. After the filing of this MIL, the Court permitted Defendants to amend
their Cross-Complaint to allege additional claims against Cross-Defendants, and
so Cross-Defendants’ argument in the MIL that the Court should not grant such
relief is moot. To the extent Cross-Defendants seek any other relief in this
MIL, it is not specific enough for the Court to make a meaningful order, and on
that basis, any request for relief is DENIED.
Cross-Defendant’s MIL No. 3 is
DEFERRED. If Defendant’s expert Brown has opinions regarding Defendant’s new
claims in the Amended Cross-Complaint, then Defendant needs to make Brown available for a deposition this week
in order for Cross-Defendant to inquire about those additional opinions. The Court expects the parties to meet and confer and confirm the deposition date with the Court at the continued FSC. If
Defendant does not make Brown available for a deposition by 2/23/24 then the Court will
grant the MIL.
