NATURE OF PROCEEDINGS:  Plaintiffs’ Motion for Admission of Matthew E. Orie Pro Hac Vice I.A.W. California Rules of Court, Rule 9.40; Motion for Admission of Richard L. Martens Pro Hac Vice I.A.W. California Rules of Court, Rule 9.40.

 

On 5/19/22, plaintiffs filed a First Amended Complaint, alleging construction defect claims against several defendants. There are also five Cross-Complaints on file.

Plaintiffs filed two motions, for Applicant Matthew E. Orie, and Applicant Richard L. Martens, to appear pro hac vice, as being attorneys in good standing in Washington State.

A judge’s determination of whether to grant an application to appear pro hac vice is evaluated under the abuse-of-discretion standard. Walter E. Heller Western, Inc. v. Sup. Ct. (1980) 111 Cal.App.3d 706, 711. The Court finds that the moving documents sufficiently comply with California Rules of Court, Rule 9.40, including the applicants’ declarations addressing the rule elements.  No party opposes the applications. The Court therefore grants the motions and will sign the proposed orders submitted by Plaintiffs.
