RELIEF REQUESTED: Approval of the compromise of the claim of the minor.¿ 

 

TENTATIVE RULING: The petition is granted. 

 

SUMMARY OF ACTION: Plaintiff/Claimant Paige Wood (“Claimant”) is a minor, bringing this personal injury action against Defendant through her parent and guardian ad litem Jacqulyn Wood. On 8/26/23, Defendant was operating a golf cart with Claimant as a passenger when the vehicle flipped over and caused Claimant’s injuries.

 

Claimant allegedly suffered “abrasion and skin lesions on her left shoulder and arm, left-sized neck spasm and pain, and right foot pain” from the incident, and received treatment in the form of “urgent care, Chiropractic care, and dermatology treatment and evaluation.” (Pet. p. 2, ¶¶ 6–7.) Claimant has continues to have temporary injuries which includes “discoloration on the skin of her left shoulder.” (Id. at ¶ 8.)

 

SETTLEMENT: Defendant to pay Claimant $75,000.00.

 

MEDICAL EXPENSES: $3,011.50 to be paid or reimbursed from settlement proceeds.

 

ATTORNEY FEES: $18,750.00 to be paid from settlement proceeds.

 

OTHER COSTS/EXPENSES: $530.51 in filing fees and retrieval of medical records.

 

AMOUNT TO BE PAID TO MINOR: $52,707.89, to be invested in a single-premium deferred annuity, subject to withdrawal only on authorization of the court.

 

CONCLUSION: The petition is granted.

 

The Court is not requesting oral argument on this matter.  Pursuant to California Rules of Court, Rule 3.1308(a)(1) notice of intent to appear is required.  Unless the Court directs argument in the Tentative Ruling, no argument will be permitted unless a “party notifies all other parties and the court by 4:00 p.m. on the court day before the hearing of the party’s intention to appear and argue.  “The tentative ruling will become the ruling of the court if no notice of intent to appear is received.”
