Case Number: 19STCV42150 Hearing Date: February 10, 2025 Dept: 52
Plaintiffs’ Motion to
Amend Judgment to Add Fictitious Business Name (DBA) to Defendant’s Name
Plaintiffs
Jose Guadalupe Beltran, Wualdin Josue Lazo, and Cerafin Hernandez move to amend
the judgment to include the fictitious business name of defendant/judgment
debtor Eden On Brand, Inc. Courts may
amend a judgment to add an alter ego or other name used by the judgment
debtor. (Favila v. Pasquarella
(2021) 65 Cal.App.5th 934, 942; Curci Investments,
LLC v. Baldwin (2017) 14 Cal.App.5th 214, 220.)
Plaintiffs
show good cause to amend the judgment. After
entry of judgment, plaintiffs discovered that Eden On Brand, Inc. registered
the fictitious business name “Eden On Brand” with the County of Los
Angeles. (Josephson Decl., ¶ 4, Ex.
A.) Plaintiffs’ counsel asserts amending
the judgment to specify this fictitious business name will avoid potential
barriers to enforcing the judgment. Amending
the judgment will not prejudice judgment debtor Eden on Brand, Inc.
Plaintiffs’ motion to amend the judgment is granted. The court will enter an amended judgment
including defendant/judgment debtor’s fictitious business name Eden On Brand.
