Defendants/Cross-Complainants’ Ex Parte Application to Shorten Time on Motion for Leave to File Second Amended Cross-Complaint

 

California Rules of Court, rule 3.1202(c) provides, “An applicant must make an affirmative factual showing in a declaration containing competent testimony based on personal knowledge of irreparable harm, immediate danger, or any other statutory basis for granting relief ex parte.” 

Defendant/cross-complainant Patrick Cheh fails to show irreparable harm or immediate danger that warrants granting ex parte relief. 

The application is denied.

            On its own motion, the court hereby advances the hearing on cross-complainant Patrick Cheh’s motion for leave to file second amended cross-complaint from February 1, 2023 to January 9, 2023, at 9:00 a.m. 

On its own motion, the court hereby continues the hearing on cross-defendants’ demurrer to the first amended cross-complaint from December 14, 2022, to January 16, 2023, at 9:00 a.m.

            The parties are hereby ordered to meet and confer within 5 days regarding whether to stipulate to the filing of a second amended cross-complaint.
