Order to Show Cause Re: Request for Entry of Default and Default Judgment
“If a responsive pleading is not served within the
time limits specified … and no extension of time has been granted, the
plaintiff must file a request for entry of default within 10 days after the
time for service has elapsed. The court
may issue an order to show cause why sanctions should not be imposed if the
plaintiff fails to timely file the request for the entry of default.” (Cal. Rules of Court, rule 3.110(g).)
Plaintiff Korea Trade Insurance Corporation, which will do business in
California as K-Sure, a Korea corporation dba K-Trade fka Korea Export
Insurance Corporation, filed proof of service of summons showing substituted
service on defendant Triplex Textile, Inc. on September 16, 2022. Defendant’s deadline to serve a responsive
pleading therefore was October 17, 2022.
The deadline passed long ago.
Plaintiff has still not requested entry of defendant’s default.
The court hereby sets an order to
show cause why plaintiff Korea Trade Insurance Corporation should not pay $100 in sanctions
under rule 3.110(g) for June 1, 2023, at 8:30 a.m.
The order
to show cause re: request for entry of default and default judgment is hereby
continued to June 1, 2023, at 8:30 a.m.
