Defendants Morruth Holdings, LLC and RMK Holdings, LLC’s Motion to Continue Trial and Related Dates

Defendants Morruth Holdings, LLC and RMK Holdings, LLC move to continue the trial and pretrial deadlines.  “The court may grant a continuance only on an affirmative showing of good cause requiring” it.  (Rule 3.1332(c).)  “A party’s excused inability to obtain essential testimony, documents, or other material evidence despite diligent efforts” indicates good cause.  (Rule 3.1332(c)(6).)

Defendants show good cause to continue the trial.  They have faced delay in receiving documents from third parties (White Decl., ¶¶ 6, 11, 14), and plaintiff recently raised new issues of lead and asbestos exposure (id., ¶ 7). 

Disposition

            Defendants Morruth Holdings, LLC and RMK Holdings, LLC’s motion to continue trial is granted.  The court hereby continues the final status conference from February 28, 2024, to June 17, 2024, at 9:00 a.m.  The court hereby continues the order to show cause re: dismissal of cross-complaint from February 28, 2024, to June 17, 2024, at 9:00 a.m.  The court hereby continues the jury trial from March 6, 2024, to July 3, 2024, at 10:00 a.m.  All pretrial deadlines are continued to follow the new trial date.
