Defendant Los Angeles Philharmonic Association’s Motions to Compel Responses to Form Interrogatories, Special Interrogatories, and Requests for Production

Defendant Los Angeles Philharmonic Association moves to compel plaintiff Isaiah Lee to respond to form interrogatories, special interrogatories, and requests for production, set one.  When the responding party fails to serve a timely response to interrogatories or requests for production, the requesting party may move for an order compelling responses.  (Code Civ. Proc., §§ 2030.290(b) [interrogatories]; 2031.300(b) [request for production].)  Failing to serve a timely response results in waiving any objections.  (Code Civ. Proc., §§ 2030.290(a); 2031.300(a).) 

Defendant is entitled to orders compelling plaintiff to respond to form interrogatories, set one, special interrogatories, set one, and requests for production of documents, set one.  Defendant served these discovery requests on plaintiff on August 30, 2024.  (Casey Decls., ¶ 2.)  Plaintiff requested an extension to respond.  Defendant agreed to extend the deadline to November 12, 2024.  (Id., Ex. B.)  But as of December 20, 2024, when defendant filed these motions, plaintiff had not served any responses.  (Casey Decls., ¶¶ 6-7.)  Plaintiff did not serve timely responses to defendant’s interrogatories and requests for production.  Plaintiff therefore waived any objections to them.

Sanctions

            In each motion, defendant moves for $685 in monetary sanctions.  Failing to respond to an authorized method of discovery is a misuse of the discovery process subject to monetary sanctions.  (Code Civ. Proc., § 2023.010(d).)  Plaintiff failed to respond to authorized discovery.  Sanctions are warranted.  Defendant reasonably incurred $685 in expenses for each motion. 

Disposition

Defendant Los Angeles Philharmonic Association’s motion to compel plaintiff Isaiah Lee to respond to form interrogatories is granted.  Plaintiff Isaiah Lee is ordered to serve verified responses without objections to defendant’s form interrogatories, set one, within 30 days.  Plaintiff Isaiah Lee is ordered to pay defendant $685 in sanctions within 30 days.

Defendant Los Angeles Philharmonic Association’s motion to compel plaintiff Isaiah Lee to respond to special interrogatories is granted.  Plaintiff Isaiah Lee is ordered to serve verified responses without objections to defendant’s special interrogatories, set one, within 30 days.  Plaintiff Isaiah Lee is ordered to pay defendant $685 in sanctions within 30 days.

            Defendant Los Angeles Philharmonic Association’s motion to compel plaintiff Isaiah Lee to respond to requests for production is granted.  Plaintiff Isaiah Lee is ordered to serve verified responses without objections to defendant’s requests for production, set one, within 30 days.  Plaintiff shall produce all responsive documents concurrently with his verified written responses.  Plaintiff Isaiah Lee is ordered to pay defendant $685 in sanctions within 30 days.
