Judge: Armen Tamzarian, Case: 24STCV13497, Date: 2025-03-21 Tentative Ruling
Case Number: 24STCV13497 Hearing Date: March 21, 2025 Dept: 52
Daniel Gibalevich, Rachel
Fishenfeld, and Ashley Soto’s Motions to be Relieved as Counsel for Plaintiffs Angela
Marina Vasquez Puluc, Carlos Orlando Puac Sept, Karla Rubiela Lopez Vasquez,
and Rudy Oswaldo Sul Lopez.
Motions to be relieved as counsel
must be made on mandatory judicial council forms MC-051, MC-051, and MC-053.
Counsel filed these motions with the required Forms MC-051, MC-052, and
MC-053. Counsel’s declarations state
that there has been an irreparable breakdown of the working relationship
between counsel and the client, including the client’s lack of cooperation and
failure to communicate.
Absent a showing of resulting prejudice, an attorney’s request for
withdrawal should be granted.¿ (People v. Prince¿(1968) 268 Cal.App.2d
398, 406.)¿ There is no showing of prejudice, and counsel’s motion complies
with California Rules of Court, Rule 3.1362 and meets its requirements.
