            Cross-Defendants Regal Medical Group, Inc. and Lakeside Medical Organization, a Medical Group, Inc.’s Motion for Entry of Judgment on Preferred IPA’s Request for Dismissal of the Cross-Complaint

Cross-defendants Regal Medical Group, Inc. (Regal) and Lakeside Medical Organization, a Medical Group, Inc. (Lakeside) move to enter judgment in their favor and against cross-complainant Preferred IPA of California, a Professional Medical Corporation (Preferred).

This action includes two consolidated cases.  The lead case is Community Family Care Medical Group IPA, Inc. v. Regal Medical Group, Inc., et al., No. BC623311.  This motion concerns the second case, Regal Medical Group, Inc., et al. v. Preferred IPA of California, No. BC635524.

On January 23, 2019, plaintiffs Regal and Lakeside requested dismissal of their entire complaint in No. BC635524 with prejudice, and the court entered the dismissal.  On October 29, 2021, defendant/cross-complainant Preferred requested dismissal of its entire cross-complaint without prejudice.  The court entered the dismissal on November 1, 2021.  The entire action in case No. BC635524 has therefore been dismissed.  Preferred did not oppose this motion.  Entry of judgment is appropriate. 

The motion is granted.  The court will sign the proposed judgment of dismissal submitted by cross-defendants Regal and Lakeside.
