Defendants,
Beecan Health CT, LLC; Beecan Health, LLC; and Serrano Post Acute, LLC dba
Hollywood Premier Healthcare Center move this Court, pursuant to Code of Civil
Procedure section 473, as follows: (1) for an order setting aside the default
and default judgment entered against Defendants on February 9, 2023 and March
2, 2023, respectively; and (2) for an order accepting the filing of Defendants’
Answer and Affirmative Defenses, filed concurrently herewith.
TENTATIVE
RULING
Defendants’, Beecan Health CT, LLC; Beecan
Health, LLC; and Serrano Post Acute, LLC dba Hollywood Premier Healthcare
Center, motion to set aside default and default judgment is DENIED as moot.
On October
6, 2023, Defendants filed a notice of withdrawal of the instant motion stating,
“Defendants Beecan Health CT, LLC, Beecan Health, LLC, and Serrano Post Acute,
LLC dba Hollywood Premier Healthcare Center hereby withdraw, without prejudice,
their Motion to Set Aside Default and Default Judgment that was previously
noticed to be heard on October 27, 2023, at 8:30 a.m., in Department E of the
above-entitled Court, located at 600 East Broadway, Glendale, CA 91206.” (Def.
