TENTATIVE RULING ON MOTION TO SET ASIDE DEFAULT AND DEFAULT JUDGEMENT

RELIEF REQUESTED
Defendants, Beecan Health, LLC and Serrano Healthcare, LLC dba Palazzo Post Acute (collectively, “Defendants”) move this Court, pursuant to Code of Civil Procedure section 473, as follows: (1) for an order setting aside the default and default judgment entered against Defendants on March 28, 2023; and (2) for an order accepting the filing of Defendants’ Answer and Affirmative Defenses, filed concurrently herewith.

TENTATIVE RULING
Defendants’ motion to set aside default and default judgment is DENIED as moot.

On October 6, 2023, Defendants filed a notice of withdrawal of the instant motion stating, “Defendants Beecan Health, LLC and Serrano Healthcare, LLC dba Palazzo Post Acute hereby withdraw, without prejudice, their Motion to Set Aside Default and Default Judgment that was previously noticed to be heard on October 20, 2023, at 8:30 a.m., in Department E of the above-entitled Court, located at 600 East Broadway, Glendale, CA 91206.” (Def. Notice of Withdrawal.)

Plaintiff’s request for judicial notice is DENIED because Defendants have filed a notice of withdrawal of the instant motion.
