TENTATIVE RULING On 12/26/2023, Defendant, S&S Entities LLC, moved for an order compelling this entire action to binding arbitration and staying the action as set forth in a written arbitration agreement signed by the Plaintiff. Defendant’s motion stated that it believed there is an automatic stay of this action by virtue of the filing of this motion. On 4/17/2024, Defendant filed a joint stipulation to remove from calendar the motion to compel arbitration. Defendant’s stipulation states that the parties agreed that the current 4/26/2024 motion to compel arbitration hearing is unnecessary as Plaintiff will not be opposing the motion and will not be opposing the stay of the action until completion of the arbitration. The stipulation requests this action be stayed pending completion of arbitration.
