TENTATIVE RULING
There is a motion on calendar for 4/12/2024 at 9:00am that is titled on eCourt as “Hearing on Motion for Order Receiver’s Motion for Further Instructions and Approval of Interim Fees and Costs.”

On 3/27/2024, Plaintiff City of Duarte, Defendants Levon H. Bardakjian and Sylvia R. Bardakjian, and Former Receiver Mark Adams and California Receivership Group Inc. (Former Receiver) filed a stipulation to continue this hearing to May 3, 2024.

The Stipulation states:

1. WHEREAS Former Receiver’s Ex Parte Application for Instructions Re November 29, 2023 Attorney Fee Order (“Former Receiver Application”) is scheduled for hearing in this department on April 12, 2024, at 9:00 a.m.;

2. WHEREAS Court-Appointed Receiver Eric P. Beatty’s (“the Receiver”) Motion for Further Instructions and Approval of Interim Fees and Costs (“Receiver Motion”) has not yet been filed, but is also scheduled for hearing in this department on April 12, 2024, at 9:00 a.m.;

3. WHEREAS the Receiver has requested that the hearings regarding the Former Receiver Application and Receiver Motion, currently scheduled for April 12, 2024 be continued to May 3, 2024, at 9:00 a.m., or such other date as is convenient for the Court as the Receiver is currently on medical leave until approximately April 1, 2024.

The Court will discuss scheduling with the parties.
