Co-Counsel, Lindsay Burton, Esq. (“Burton”), for Plaintiff Jorge Martinez (“Plaintiff”) seeks to be relieved as counsel asserting there is a fundamental disagreement between Plaintiff and Burton regarding the prosecution of the case. Burton asserts that Burton and Burton’s law firm were associated as counsel for Plaintiff on November 8, 2019, and that co-counsel Jonathan Kashani, who was the original attorney of record for this matter, will remain counsel for Plaintiff.
However, while Burton filed a declaration, Burton failed to file a declaration on judicial council form MC-052, which is mandatory. (Cal. Rules of Court, rule 3.1362.) Therefore, the motion must be denied without prejudice.
Counsel is ordered to give notice.
