[TENTATIVE] ORDER GRANTING DEFENDANT’S UNOPPOSED MOTION TO COMPEL Dept. 31 1:30 p.m. August 16, 2022 |
Defendant Mollie Quintana (“Defendant”) propounded supplemental requests for production of documents (“RPDs”) on Plaintiff Rodney Jordan (“Plaintiff”) on April 27, 2020. To date, despite extensions of time to respond, attempts to meet and confer, and Defendant re-serving the discovery multiples times, Plaintiff has not served responses. Defendant therefore seeks an order compelling Plaintiff to respond, without objections, to the outstanding discovery and to pay sanctions.
Defendant’s motion is unopposed and granted. Plaintiff is ordered to serve verified responses to supplemental RPDs, first served on Plaintiff on April 27, 2020, without objections, within fifteen (15) days. (CCP § 2031.300(a), (b).)
Sanctions are mandatory. (CCP § 2031.300(c).) The court awards Defendant one hour for preparing the form motion to compel and one hour to appear at the hearing all at the reasonable rate of $185 per hour, for a total of $370 in attorney fees. Further, the court awards Defendant the motion filing fee of $61.65 as costs.
Sanctions are sought and imposed against Plaintiff, who is in pro per. Plaintiff is ordered to pay sanctions to Defendant, by and through counsel of record, in the total amount of $431.65, within twenty days.
Defendant is ordered to give notice.
