[TENTATIVE] ORDER TAKING DEFENDANT’S MOTION TO COMPEL FURTHER OFF CALENDAR Dept. 31 1:30 p.m. January 17, 2023 |
Defendant City of Los Angeles’ (“Defendant”) motion to compel further responses to request for admissions, set one, was originally set for hearing on September 6, 2022, where it was continued to December 19, 2022, for the parties to participate in an Informal Discovery Conference (“IDC”). The parties were ordered to file a joint statement outlining any remaining issues two weeks before the continued hearing, if all issues were not resolved at the IDC. (Min. Order, Sept. 6, 2022.) The parties participated in an IDC concerning the subject discovery on November 30, 2022, where the issues were deemed resolved, and Plaintiff agreed to provide responses without objections within a week. The parties were ordered to further meet and confer, and the motion was continued to January 17, 2023. (Min. Order, Nov. 30, 2022.) To date, no party has filed anything additional relating to the motion to compel further responses. Furthermore, the Court notes that on January 3, 2023, Defendant’s unopposed motion for summary judgment as to the claim against it in the complaint was granted. Defendant has filed a proposed judgment regarding the ruling.
Therefore, the Court presumes all issues remain resolved and there is nothing going forward at this time. The Court asks Counsel to ensure matters are promptly taken off calendar using the CRS online reservation system when they become moot.
Defendant is ordered to give notice.
