Plaintiff Celedonio Alabat’s (“Plaintiff”) attorney of record, Hesam Yazdanpanah and Law Offices of Hess Panah & Ass. (“Counsel”), moves to be relieved as counsel for Plaintiff. Counsel contends relief is necessary because there has been a loss of communication with Plaintiff, as Plaintiff does not respond to Counsel’s phone calls and cannot be located. Counsel has filed proof of service on Plaintiff and Defendant. Counsel provides it has served the moving papers on Plaintiff at Plaintiff’s last known address; however, Counsel was unable to confirm Plaintiff’s address was current.
The motion is denied without prejudice because Counsel declares he has not been able to confirm if Plaintiff’s address is current in the past thirty days. If Counsel is unable to serve Plaintiff at a confirmed address, Counsel must serve the moving papers on the Clerk of the Court- located at Stanley Mosk Courthouse- pursuant to CCP §1011 and California Rules Court, rule 3.1362(d). Counsel should take note of this for all cases in which counsel seeks to be relieved under these circumstances.
Moving Counsel is ordered to give notice.
