SUPERIOR COURT OF THE STATE OF CALIFORNIA

FOR THE COUNTY OF LOS ANGELES - CENTRAL DISTRICT

Plaintiffs Noemi Martell and Randy Martell (collectively, “Plaintiffs”) filed this action against defendants County of Los Angeles the “County”), Los Angeles County Sheriff’s Department (“LACSD”), Danny Soto, Timothy Michael Sanford (“Sanford”), and Horacio Ortega (“Ortega”) for damages arising from a motor vehicle accident.  This action has been deemed related to Case No. 20AVCV00218. 

At this time, Plaintiffs move to compel the depositions of (1) LACSD’s employees and person most knowledgeable (“PMK”), (2) Sanford, and (3) Ortega.  Sanford and Ortega filed a joint opposition to the motions against them, and LACSD filed an opposition to the motion against it.  Plaintiff filed a reply to the oppositions. 

This matter was last heard on July 5, 2022, where it was continued to August 4, 2022, to allow counsel for Defendant to appear after the court was informed the County’s counsel did not receive notice of the July 5 hearing.  (Min. Order, July 5, 2022.)  Plaintiff was ordered to give notice of the continuance to August 4 hearing date.  (Id.)  As of August 1, 2022, Plaintiff has not filed proof of service of any such notice with this court. 

However, if the parties’ consent, the court intends to go forward with the hearing on August 4, 2022.  All counsel should be present.  If an objection is raised to going forward due to lack of notice, the court will consider continuing the hearing very briefly. 

No other tentative will be posted prior to hearing.

• Parties are encouraged to meet and confer after reading this tentative ruling to see if they can reach an agreement.
• If a party intends to submit on this tentative ruling, the party must send an email to the court at sscdept31@lacourt.org with the Subject line “SUBMIT” followed by the case number.  The body of the email must include the hearing date and time, counsel’s contact information, and the identity of the party submitting.  
• Unless all parties submit by email to this tentative ruling, the parties should arrange to appear remotely (encouraged) or in person for oral argument.  You should assume that others may appear at the hearing to argue.  
• If the parties neither submit nor appear at hearing, the Court may take the motion off calendar or adopt the tentative ruling as the order of the Court.  After the Court has issued a tentative ruling, the Court may prohibit the withdrawal of the subject motion without leave.
