Petitioner Dunia E. Varela (“Petitioner”) filed the instant petition for approval of compromise of claim pertaining to minor Christopher D. Rios (“Claimant”) on September 27, 2022, setting it for hearing for October 31, 2022.  On October 31, 2022, there were no appearances by Petitioner, Claimant, or their counsel.  The Court, thus, continued the hearing to December 8, 2022, and ordered Plaintiffs to give notice.  Further, an Order to Show Cause Re: Sanctions for Failure to Appear as to Claimant, Petitioner, and Plaintiff’s Counsel of up to $250.00 was also set for hearing for December 8, 2022.

Plaintiff’s counsel filed a declaration stating that his failure to appear at the October 31, 2022, hearing was due to inadvertence or mistake related to registering for LA Court Connect.  However, to date, no notice of the continued hearing with proof of service on the parties has been filed.  Thus, it is unclear that Plaintiff has provided notice of the new hearing date to all parties and that the hearing can go forward on December 8, 2022. 

Plaintiff’s counsel must appear at the hearing at 1:30 on December 8, 2022, to discuss this matter further.  If all parties appear and consent to going forward on the petition, the Court will consider whether to do so at that time.   

Petitioner is ordered to give notice.

• Parties are encouraged to meet and confer after reading this tentative ruling to see if they can reach an agreement.
• If a party intends to submit on this tentative ruling, the party must send an email to the court at sscdept31@lacourt.org with the Subject line “SUBMIT” followed by the case number.  The body of the email must include the hearing date and time, counsel’s contact information, and the identity of the party submitting.  
• Unless all parties submit by email to this tentative ruling, the parties should arrange to appear remotely (encouraged) or in person for oral argument.  You should assume that others may appear at the hearing to argue.  
• If the parties neither submit nor appear at hearing, the Court may take the motion off calendar or adopt the tentative ruling as the order of the Court.  After the Court has issued a tentative ruling, the Court may prohibit the withdrawal of the subject motion without leave.
