Plaintiff Dean Quiroz’s (“Plaintiff”) attorney of record, Karla Ruiz, Esq. (“Counsel”), moves to be relieved as counsel for Plaintiff. Counsel contends relief is necessary because attorney-client communications have broken down, and Plaintiff is unwilling to cooperate with Counsel regarding the handling of this case. Counsel declares it served the moving papers on Plaintiff via mail at Plaintiff’s last known address after confirming the address as current by using Westlaw PeopleMap.
On August 11, 2022, Counsel filed proof of service showing the moving papers were mailed to a single address in Anaheim, California; however, the proof of service does not indicate on whom the papers were served. Counsel must file proof of service of the motion, declaration, and proposed order on Plaintiff and all parties that have appeared in the action. (Cal. Rules of Court, rule 3.1362(d).)
Counsel is ordered to give notice.
