Plaintiff Yoni Rolando Solis’s (“Plaintiff”) attorney of record, Russell F. Behjatnia, Esq. (“Counsel”), seeks to be relieved as counsel contending there has been a breakdown in the attorney-client relationship. Counsel declares he served the moving papers on his client via mail at the client’s last known address. Counsel has filed proof of service on Plaintiff and on Defendant that has appeared in this action.
The motion is unopposed and granted; the ruling is effective upon filing proof of service of the final order. The Court notes the next scheduled matter is a Final Status Conference set for June 2, 2023, and trial is not scheduled until June 12, 2023. Therefore, there is sufficient time for Plaintiff to seek other counsel or otherwise prepare prior to trial.
Counsel is ordered to give notice.
