SUPERIOR COURT OF THE STATE OF CALIFORNIA

Defendant Golden State Water Company (“Defendant”) initially set this Motion to Compel Further Responses to Request for Production of Documents, set two, for hearing on August 30, 2022, where it was continued to October 5, 2022, pursuant to a notice of continuance filed by Defendant. 

If the parties were unable to resolve the issues prior to the continued hearing, the parties were required to submit a joint statement of items in dispute at least nine court days prior to the hearing.  (Min. Order, Aug. 25, 2022.)  Further, it was noted that if further responses were served after the previous Informal Discovery Conference scheduled by Defendant, a new IDC would have to be held concerning the supplemental responses. 

As of September 30, 2022, no joint statement or further briefing relating to the motion has been filed.  The Court is hopeful that the parties have resolved their dispute, and Defendant intends to take the motion to compel off calendar. 

If the parties have not resolved their dispute, they must appear at the hearing on the motions and be prepared to discuss any remaining outstanding issues.  The hearing will be continued again for the parties to file the required joint statement nine days prior to the continued hearing date.  Failure to do so with no explanation will result in the hearing being taken off calendar.   

Moving Defendant is ordered to give notice.

• Parties are encouraged to meet and confer after reading this tentative ruling to see if they can reach an agreement.
• If a party intends to submit on this tentative ruling, the party must send an email to the court at sscdept31@lacourt.org with the Subject line “SUBMIT” followed by the case number.  The body of the email must include the hearing date and time, counsel’s contact information, and the identity of the party submitting.  
• Unless all parties submit by email to this tentative ruling, the parties should arrange to appear remotely (encouraged) or in person for oral argument.  You should assume that others may appear at the hearing to argue.  
• If the parties neither submit nor appear at hearing, the Court may take the motion off calendar or adopt the tentative ruling as the order of the Court.  After the Court has issued a tentative ruling, the Court may prohibit the withdrawal of the subject motion without leave.
