Defendants PPG Industries, Inc., Casella Trust and Connie M. Casella filed the instant motion for summary judgment on November 14, 2022, setting it for hearing in Department 31 at the Spring Street Courthouse.  However, this action is assigned to the Honorable Jill Feeney’s Department 30 at the Spring Street Courthouse.  Notably, the notice of motion incorrectly provides the motion was reserved for hearing in Department 30.  Therefore, this Court takes the motion for summary judgment off calendar for hearing in this Department.  Moving Defendants must re-file the motion properly for hearing in Department 30.

Defendants are ordered to give notice.

• Parties are encouraged to meet and confer after reading this tentative ruling to see if they can reach an agreement.
