[TENTATIVE] ORDER DENYING WITHOUT PREJUDICE PETITION TO APPROVE COMPROMISE OF MINOR

Plaintiffs Xiuying Lin (“Petitioner”) and Peggy Wen (“Claimant”), a minor by and through her guardian ad litem, Petitioner, filed this action against Defendants Yuehua Jin (“Defendant”) for damages arising from a motor vehicle accident.

On January 3, 2023, Petitioners filed a Petition for Approval of Compromise of Claim or Action pertaining to Claimant, setting the matter for hearing for January 10, 2023. Consequently, Petitioner filed the petition only seven days before the hearing. A petition to approve a minor’s compromise requires at least 15 days’ notice prior to the hearing. (Prob. Code §§ 1460, 2506.)

Therefore, the petition is denied without prejudice at this time. Petitioner must comply with all filing and notice requirements when re-filing the petitions. An oral request to continue the hearing on the instant petition will not be entertained.

Petitioner is ordered to give notice.
