[TENTATIVE] ORDER FINDING MOTION FOR SUMMARY JUDGMENT MOOT

Defendants World Oil Corporation, World Oil Marketing Company and Matthew Pakkala (collectively, “Defendants”) initially set the instant motion for summary judgment on February 25, 2022, with it being set for hearing on July 22, 2022.  (Min. Order June 7, 2022.) 

 

On June 20, 2022, Defendants filed a Notice of Settlement providing that Defendants and Plaintiff have settled the action with Plaintiff agreeing to dismiss the action against Defendants with prejudice.  Defendants state the settlement is contingent upon a finding of good faith.  Pursuant to Defendants’ request, the July 22, 2022 hearing was continued to September 16, 2022.  However, the Court notes that on July 26, 2022, the Court granted Defendants’ application for determination of good faith settlement pursuant to CCP § 877.6. 

 

No party has filed anything additional relating to the motion for summary judgment, and the application for determination of good faith settlement has now been granted.  Accordingly, the Court presumes the motion is moot and not going forward.  The Court requests that in the future moving counsel promptly take matters off calendar when they become moot or are no longer going forward. 

 

The Court, thus, takes the motion for summary judgment off-calendar and moving admonishes counsel for not doing so.

 

Moving Defendants are ordered to give notice.
