[TENTATIVE] ORDER GRANTING MOTION TO BE RELIEVED AS COUNSEL

Plaintiff Anastacia Parfan’s (“Plaintiff”) attorney of record, Hesam Yazdanpanah (“Counsel”), seeks to be relieved as counsel, contending there has been a breakdown in attorney-client communications.  Counsel declares it served the moving papers on Plaintiff via mail at Plaintiff’s last known address.  Counsel has filed proof of service on Plaintiff and on Defendant.  Further, although Counsel states it has not been able to confirm that the address for Plaintiff is current, Counsel served the moving papers on the Clerk of the Court pursuant to CCP §1011(b) and California Rules Court, rule 3.1362(d). 

 

The motion is unopposed and granted; the ruling is effective upon filing proof of service of the final order.  The Court notes the next scheduled matter is the Final Status Conference set for January 11, 2024, and trial is not scheduled until January 25, 2024.  Therefore, there is sufficient time for Plaintiff to seek other counsel or otherwise prepare for trial.

 

Counsel is ordered to give notice.
