Defendants Rebecca June Grossman and Peter Grossman (collectively, “Defendants”) seek an order to issue a commission to take an out-of state deposition of David Huelson (“Huelson”). Defendants provide that Huelson was a detective for the Los Angeles County Sheriff’s Department and conducted an investigation of the subject accident involving Defendants. The court does not hear requests for issuance of out-of-state commissions by way of noticed motion. Instead, issuance of these commissions is a ministerial act, and is done by Clerk of the Court located at the Stanley Mosk Courthouse. It is noted that there is a Judicial Council form designed for such a request, and it provides certain language concerning the terms of the deposition and the authority upon which the commission is authorized that are not present in Defendants’ Proposed Order. (See Judicial Council Form Disc-030.)
The motion is denied without prejudice to Defendants’ right to procure the commission from the Clerk of the Court.
Defendants are ordered to give notice.
