[TENTATIVE] ORDER GRANTING MOTION TO BE RELIEVED AS COUNSEL

R. Alexander Comley (“Counsel”) seeks to be relieved as Plaintiff Piero Valdizan’s (“Plaintiff”) attorney of record.  Counsel asserts that irreconcilable differences have arisen between Counsel and Plaintiff that make it unreasonably difficult to carry out employment effectively.  Counsel has filed proof of service on Plaintiff and Defendants.  Counsel provides Plaintiff’s address was confirmed as current through email, where Counsel and Plaintiff regularly communicate.  (See Cal. Rules of Court, Rule 3.1362(d)(2).)  Further, Counsel provides that Counsel also served Plaintiff through the same email address used to communicate with Plaintiff. 

 

The motion is unopposed and granted; the ruling is effective upon filing proof of service of the final order.  The Court notes the next scheduled matter is a Status Conference set for February 16, 2023, and trial is not yet scheduled.  Therefore, there is sufficient time for Plaintiff to seek other counsel or otherwise prepare for trial.

 

Counsel is ordered to give notice.
