Plaintiff Mustapha Assim (“Plaintiff”) filed this action against Defendant Tera Tera Inc. (“Defendant”) for injuries Plaintiff allegedly sustained when he was shopping at Defendant’s store. 

On August 1, 2022, Defendant filed the instant motion for summary judgment as to Plaintiff’s complaint.  However, on November 30, 2022, Defendant’s motion for terminating sanctions against Plaintiff was granted.  Plaintiff’s complaint against Defendant was ordered dismissed.  In light of the order dismissing the complaint against Defendant, Defendant’s motion for summary against Plaintiff is moot.  The motion is taken off-calendar.
