[TENTATIVE] ORDER GRANTING DEFENDANT’S UNOPPOSED MOTION TO DEEM REQUEST FOR ADMISSIONS ADMITTED

Defendant CHK Lincoln Property LLC propounded request for admissions (“RFAs”), set one, on Plaintiff Thomas Roney (“Plaintiff”) on September 2, 2022. To date, despite an attempt to meet and confer and extension of time to respond, Plaintiff has not served responses. Defendant therefore seeks an order deeming the RFAs admitted and imposing sanctions.

Defendant’s motion to deem RFAs admitted is unopposed and granted. (CCP §2033.280(b).)

Defendant requests sanctions of $568.65 for preparing the motion. However, Defendant does not identify against whom the sanctions are sought. “A request for a sanction shall, in the notice of motion, identify every person, party, and attorney against whom the sanction is sought, and specify the type of sanction sought.” (CCP § 2023.040.) Thus, no sanctions are awarded for the motion to deem RFAs admitted.

Defendant is ordered to give notice.
