Plaintiff Julie Choi (“Plaintiff”) filed the instant motion to compel responses to special interrogatories, set one, on August 1, 2022, setting it for hearing on August 25, 2022.  On August 18, 2022, Plaintiff filed a Notice of Settlement of Entire Case providing that the parties entered into a conditional settlement, and a request for dismissal will be filed no later than November 16, 2022.  Following the notice of settlement, no party has filed anything further concerning this motion.  The Court presumes the motion is moot and not going forward.  The Court will thus take the motion for summary judgment off calendar.

            As a final matter, the Court notes that Plaintiff reserved the instant motion as a Motion to Compel Further Responses; however, Plaintiff’s moving papers assert that Plaintiff is moving to compel initial responses.  In the future, Plaintiff’s counsel should ensure to properly reserve all motions, as failure to do so may result in matters being continued or taken off calendar. 

Plaintiff is ordered to give notice.

• Parties are encouraged to meet and confer after reading this tentative ruling to see if they can reach an agreement.

• If the parties neither submit nor appear at hearing, the Court may take the motion off calendar or adopt the tentative ruling as the order of the Court.  After the Court has issued a tentative ruling, the Court may prohibit the withdrawal of the subject motion without leave.
