Counsel Alex Guerrero filed the instant motion to be relieved as Plaintiff’s attorney of record on September 19, 2022, which was only three court days before the hearing. “Unless otherwise ordered or specifically provided by law, all moving and supporting papers shall be served and filed at least 16 court days before the hearing.” (CCP § 1005(b) [emphasis added].) Further compounding this apparent defect is that moving Counsel failed to attach any proof of service to the moving papers. Moving Counsel’s motion is therefore clearly improper and fails to give sufficient notice.
The motion to be relieved is denied without prejudice.
Moving Counsel is ordered to give notice.
