Plaintiff Candid Soto’s(“Plaintiff”) attorney of record, Alex Guerrero (“Counsel”), seeks to be relieved as counsel asserting that Plaintiff is in breach of the attorney-client fee agreement, which has created a conflict and a breakdown in the attorney-client relationship. Counsel declares it served the moving papers on Plaintiff via mail at Plaintiff’s last known address. Counsel has filed proof of service on Plaintiff.
However, the Court cannot locate proof of service of the motion, declaration, and proposed order on all other parties who have appeared in the case. (Cal. Rules of Court, rule 3.1362(d).) The Court’s records show that City of Los Angeles and Los Angeles County Metropolitan Transportation Authority have appeared in this action.
Therefore, the motion to be relieved is denied without prejudice.
Moving Counsel is ordered to give notice.
