Plaintiff Angela Hoenig’s (“Plaintiff”) attorney of record, Brett Yorke, Esq. (“Counsel”), seeks to be relieved as counsel contending there has been an irreconcilable breakdown in the attorney-client relationship. Counsel declares he served the moving papers on Plaintiff via mail at Plaintiff’s last known address. Counsel has filed proof of service on Plaintiff and on defendant Gregory McKay, who has appeared in the action.
The motion is unopposed and granted; the ruling is effective upon filing proof of service of the final order. The Court notes the next scheduled matter is a Final Status Conference set for August 7, 2022, and trial is not scheduled until August 21, 2023. Therefore, there is sufficient time for Plaintiff to seek other counsel or otherwise prepare for trial.
Counsel is ordered to give notice.
