Plaintiff Irma Gallegos Hernandez’s (“Plaintiff”) attorney of record, Sasha Tymkowicz, Esq. (“Counsel”), seeks to be relieved as counsel, attesting that it would not be beneficial to Plaintiff for Counsel to continue representing Plaintiff’s interests in this case. Counsel declares it served the moving papers on Plaintiff via mail at Plaintiff’s last known address. Counsel has filed proof of service on Plaintiff and on all parties that have appeared in the action.
The motion is unopposed and granted; the ruling is effective upon filing proof of service of the final order. The court notes the next scheduled matter is a motion to compel discovery set for September 29, 2022. The court encourages Plaintiff to seek new counsel expeditiously to protect Plaintiff’s interests in this matter. Trial is not scheduled until January 9, 2023, and therefore, there is sufficient time for Plaintiff to seek other counsel or otherwise prepare prior to trial.
Counsel is ordered to give notice.
