Plaintiffs Emerita Damaris Centeno De Lacayo (“Emerita”), Jose Gilbert Lacayo Ayala (“Ayala”), and Fernando Saul Lacayo (“Claimant”), a minor by and through his guardian ad litem, Saul Gilberto Lacayo Nolasco (“Petitioner”), filed this action against Defendant Elina Bianca Qasabian (“Defendant”) for damages arising from a motor vehicle accident with Defendant’s vehicle. 

On January 9, 2023, Petitioner filed the instant Petition for Approval of Compromise of Claim or Action pertaining to Claimant, setting it for hearing on January 17, 2023.  This was only eight days before the hearing.  A petition to approve a minor’s compromise requires at least 15 days’ notice prior to the hearing.  (Prob. Code §§ 1460, 2506.) 

Therefore, the petition is denied without prejudice at this time.  Petitioner must comply with all filing and notice requirements when re-filing the petition.  An oral request to continue the hearing on the instant petition will not be entertained. 

Petitioner is ordered to give notice.

• Parties are encouraged to meet and confer after reading this tentative ruling to see if they can reach an agreement.
