Plaintiff(s), vs. SAAD CHOUDHURY, ET AL., Defendant(s). | ) ) ) ) ) ) ) ) ) ) ) |
[TENTATIVE] ORDER GRANTING DEFENDANT’S MOTION TO COMPEL Dept. 31 1:30 p.m. January 24, 2023 |
Defendant Saad Choudhury (“Defendant”) propounded request for production of documents (“RPDs”), set one, on Plaintiff Benchmark Insurance (“Plaintiff”) on May 10, 2022. To date, despite attempts to meet and confer and extensions of time to respond, Plaintiff has not served responses. Defendant therefore seeks an order compelling Plaintiff to respond, without objections, to the outstanding discovery and to pay sanctions.
Defendant’s motion is unopposed and granted. Plaintiff is ordered to serve verified responses to RPDs, set one, without objections, within ten days. (CCP § 2031.300(a), (b).)
Sanctions are mandatory. (CCP § 2031.300(c).) Defendant requests sanctions of $432.00. The request is reasonable and supported by defense counsel’s declaration. (Mot. Harmon Decl. ¶ 8.) Defendant seeks sanctions against Plaintiff and Plaintiff’s attorney of record. Defendant does not describe any conduct warranting sanctions against Plaintiff personally. The evidence shows the discovery and meet and confer letters were served on Plaintiff’s counsel, but Plaintiff’s counsel did not respond to such. Sanctions are imposed against Plaintiff’s attorney of record only. Plaintiff’s counsel is ordered to pay sanctions to Defendant, by and through counsel of record, in the total amount of $432.00, within twenty days.
Defendant is ordered to give notice.
