Plaintiff Michael Yedor’s (“Plaintiff”) attorney of record, Nicholas P. Kohan (“Counsel”), moves to be relieved as counsel, contending that irreconcilable differences have arisen between Plaintiff and Counsel making it unreasonably difficult to carry out the employment effectively. Counsel declares the moving papers were served on Plaintiff via mail at Plaintiff’s last known address after confirming the address as current through text message. Counsel has filed proof of service on Plaintiff.
However, the proof of service attached to the moving papers indicates that they were served on Plaintiff by email. California Rules of Court, Rule 3.1362(d)(2) states: “If the notice is served on the client by electronic service under Code of Civil Procedure section 1010.6 and rule 2.251, it must be accompanied by a declaration stating that the electronic service address is the client's current electronic service address.” The Court cannot locate any such declaration with Counsel’s motion.
Therefore, Counsel’s motion to be relieved is denied without prejudice.
Counsel is ordered to give notice.
