[TENTATIVE] ORDER CONDITIONALLY GRANTING PETITION TO APPROVE COMPROMISE OF MINOR

Plaintiff Darnell Vaughn (“Plaintiff”), a minor by and through his guardian ad litem, Bernadette Carter (“Petitioner”), filed this action against Defendants Lyft, Inc. and Angele Wilfredo Perez-Alvarado (collectively, “Defendants”) for damages arising from a motor vehicle vs. pedestrian accident.  Plaintiff was laying in the street after falling off his bicycle when he was struck by Defendants’ vehicle.  Plaintiff suffered multiple injuries to his head, chest, liver, and extremities.  Plaintiff has now recovered completely from the effects of the injuries. 

 

Plaintiff has agreed to settle all claims with Defendants for the total amount of $500,000.00.  If the settlement is approved, $70,181.91 will be used for medical expenses, $125,000.00 for attorney fees, and $8,829.50 will be used for costs.  The net balance of $295,988.59 will be deposited into a blocked account. 

 

The Court has reviewed the settlement and finds it fair and reasonable.  The Court also finds the attorney fees fair and reasonable, in that they amount to 25% of the minor’s settlement.  

 

Pursuant to CRC 7.952, Plaintiff and Petitioner must appear at the hearing on this matter unless the Court finds good cause to excuse their appearance.  Plaintiff herein is 16 years old, and thus, Plaintiff will be required to appear, along with Petitioner, at the hearing.  They are encouraged to appear remotely.  If the Court is satisfied with Petitioner’s and Plaintiff’s testimony, the Court will grant the petition.

 

Petitioner is ordered to give notice.
