Plaintiff Ron A. Rosen Janfaza (“Janfaza”) filed this action against Defendant, Omid Khorshidi (“Khorshidi”) for damages relating to an alleged physical altercation between Plaintiff and Defendant that occurred at the Santa Monica Courthouse on May 26, 2016.  Khorshidi has filed a cross-complaint against Janfaza for damages arising out of the same incident. 

On August 24, 2022, the Court issued an order granting Khorshidi’s motion to appoint a discovery referee in this matter.  The Court ordered in pertinent part:

[T]he parties are to meet and confer regarding the selection of a referee. If the parties cannot agree upon a referee, they are each to prepare a list of three nominees, from which the Court will appoint a referee pursuant to CCP § 640. A further hearing is set for 1:30 p.m. on September 6, 2022 regarding the selection of a discovery referee. The parties’ joint statement regarding the selection and/or nomination of a discovery referee is to be filed five (5) court days prior to the hearing.

            On August 29, 2022, the parties filed a Joint Statement Re: Appointment of Discovery Referee wherein each Janfaza and Khorshidi nominate three referee candidates. 

The Court has reviewed each party’s proposed candidates and the evidence submitted with the joint statement and hereby appoints the Hon. Robert W. Thomas as the discovery referee in this matter.

Khorshidi is ordered to give notice.

• Parties are encouraged to meet and confer after reading this tentative ruling to see if they can reach an agreement.
• If a party intends to submit on this tentative ruling, the party must send an email to the Court at sscdept31@lacourt.org with the Subject line “SUBMIT” followed by the case number.  The body of the email must include the hearing date and time, counsel’s contact information, and the identity of the party submitting.  
• Unless all parties submit by email to this tentative ruling, the parties should arrange to appear remotely (encouraged) or in person for oral argument.  You should assume that others may appear at the hearing to argue.  
• If the parties neither submit nor appear at hearing, the Court may take the motion off calendar or adopt the tentative ruling as the order of the Court.  After the Court has issued a tentative ruling, the Court may prohibit the withdrawal of the subject motion without leave.
