The Motion for Leave to File First Amended Complaint brought by plaintiff/cross-defendant Beshay Foods Inc. (Plaintiff) is GRANTED. Leave to amend is liberally granted under California law. Plaintiff has complied with the requirements of California Rules of Court, rule 3.1324. The Court finds the arguments of defendant Casitas Oceanside Three L.P. (the Landlord) regarding prejudice and delay to be unpersuasive.
