The Motion for Leave to Amend Cross-Complaint brought by defendants/cross-complainants Mark Dillon, Logan Dillon, and Oceanside Beach Rental (collectively, Defendants) is GRANTED. The matter has been properly noticed, with proof of service on file. The motion is unopposed. Failure to oppose constitutes an admission and/or waiver that a motion is meritorious.
It appears that Defendants have failed to comply with California Rules of Court, rule 3.1324(a)(1) because a copy of the proposed amended cross-complaint is not on file. However, as the matter is unopposed, the Court overlooks this deficiency. Nonetheless, for administrative purposes, Defendants will need to separately serve and e-file a fresh, clean copy of the proposed 'First Amended Cross-Complaint' on or before Friday, October 20, 2023. Failure to e-file said copy within that time frame may result in rejection of, or summary striking of, the late-filed amended cross-complaint.
