The Application to Appear As Counsel Pro Hac Vice brought by attorney Bradley Burns (Attorney Burns) to represent defendant Xcentric Ventures LLC (Defendant) is GRANTED.
The matter has been properly noticed, with proof of service on file. While the application itself fails to specifically identify an 'active licensee of the State Bar of California' that is 'associated as attorney of record' as required by California Rules of Court, rule 9.40(a) and (d)(6), other documents in the file indicate that two of the lawyers at Attorney Burns' firm of Dickinson Wright PLLC are licensed California attorneys. Attorney P. Bruce Converse (Attorney Converse) specifically was named as co-counsel in this case. (See ROA 25.) As such, the Court deems that the requirements of California Rules of Court, rule 9.40 have been satisfied.
The Court notes, for the edification of the parties, that Government Code ยง 70617(e)(2) imposes an ongoing requirement that counsel who are admitted pro hac vice are to pay an annual renewal fee of $500 to the appropriate superior court each year that the attorney maintains pro hac vice status.
If the parties are satisfied with the above tentative ruling or do not otherwise wish to argue the motion, they are encouraged to give notice to the Court and each other of their intention not to appear, though this notice is not required.
