CASE TITLE: CASE TYPE:

Civil - Unlimited  PI/PD/WD - Other Discovery Hearing 37-2022-00049127-CU-PO-NC JONES VS. JONES [IMAGED] CAUSAL DOCUMENT/DATE FILED: Motion to Compel Discovery, 10/18/2023

The Amended [Corrected & Updated] Motion for Order Compelling Kasey JonesRebandt to Supply Legally Compliant Answers to Special Interrogatories brought by plaintiff Elsie Jones (Plaintiff) is DENIED. Notice of a motion, and the supporting papers of a motion, must be filed and served at least 16 court days before the hearing. (Code of Civil Procedure ยง 1005.) The hearing here is set for November 3, 2023. Sixteen court days (which, generally speaking, exclude weekends and holidays) would require the motion to have been served and filed by no later than October 12, 2023. The proof of service accompanying the motion indicates that service was actually made on October 17, 2023. (ROA 34.) As this is untimely, and as no opposition brief has been filed, the motion cannot be granted.

Unless the ruling(s) above indicate that an appearance is necessary, parties who wish to submit, who are satisfied with the above tentative ruling(s), and/or who do not otherwise wish to argue the motion(s) are encouraged to give notice to the Court and each other of their intention not to appear.
