The Amended [Corrected & Updated] Motion for Order Compelling Kasey JonesRebandt to Supply Legally Compliant Answers to Special Interrogatories brought by plaintiff Elsie Jones (Plaintiff) is DENIED. Notice of a motion, and the supporting papers of a motion, must be filed and served at least 16 court days before the hearing. (Code of Civil Procedure § 1005.) The hearing here is set for November 3, 2023. Sixteen court days (which, generally speaking, exclude weekends and holidays) would require the motion to have been served and filed by no later than October 12, 2023. The proof of service accompanying the motion indicates that service was actually made on October 17, 2023. (ROA 34.)
