1. TENTATIVE RULING:


Defendant's motion to compel the in-person deposition of Plaintiff is granted on the following conditions: (1) that the deposition be conducted in a conference room large enough to seat at least 12 persons and that the attendees distance themselves from Plaintiff as much as practicable; (2) that attendance at the deposition be limited to the court reporter, 2 lawyers for defendants, and Plaintiff; (3) that all attendees test negative for COVID-19 within 4 hours prior to the deposition (a representation on the record to that effect will suffice) ; and (4) that all attendees wear a KN-95, N-95, or comparable mask throughout the deposition (except when taking a drink).

Absent further order of the Court or agreement of the parties, the deposition shall occur within 10 days of the date of this order.

Defendant's request for monetary sanctions is denied.
