Plaintiff SANDRA E. GARCIA’s Motion to Compel Further Responses to Request for Production of Documents (set one) is OFF-CALENDAR pursuant to the CMC Order issued on February 4, 2025.

 

The Court notes that a Notice of Reassignment was filed in this case on May 5, 2025 which states that on June 2, 2025, this action was reassigned to Judge Brian F. Gasdia as an individual, direct calendaring judge for all purposes, including trial, in Dept. R.

This lemon law action was filed by Plaintiff SANDRA E. GARCIA (“Plaintiff”) against Defendant NISSAN NORTH AMERICA, INC. (“Defendant”) and Does 1 through 10, inclusive on May 15, 2024.  

 

Plaintiff’s Subject Motion to Compel Further Responses to Request for Production of Documents (set one) was filed on January 30, 2025.

 

After this Subject Motion was filed, on February 4, 2025, the Court issued the operative Case Management Conference Order, which states that “under CCP §2019.020(b)… the sequence and timing of discovery in this matter should be the subject of management by the Court….” (02/04/25 CMC Order).  

 

The CMC Order states, in relevant part: “Absent written agreement of the parties to the contrary, any formal discovery propounded and currently pending or outstanding by a party in this matter prior to the date of this CMC Order is stayed pending further order of the Court.” (Id.) Paragraph 2 of the CMC Order identifies what documents the parties are required to produce. Paragraph 4 of the CMC Order contains the deposition guidelines for this action.

 

Plaintiff’s Motion is rendered MOOT by the Court’s issuance of the CMC Order after the Motion was filed. The Motion is placed OFF-CALENDAR.
