 Tentative ruling: OSC Enry Default Judgment

 The Request for default judgment is denied.

 The request for $59,266.20 exceeds the amount requested in the Complaint ($18,466.20) and the request for emotional support damages ($36,000) is not supported by adequate evidence. (Norales Decl., ¶ 42.) Additionally, Plaintiff’s request for attorney fees in the amount of $17,207 is not consistent with LASC 3.214 and grossly excessive for uncontested case. Finally, the interest calculation incorrectly applies a rate of 10% to Plaintiff’s noncontract claims. (Civ. Code, § 3289.)  

 At the earing the Court will set a hearing date for an amended application for a default judgment.
