Plaintiff Eduardo Pena's Amended Motion for Preliminary Approval of Class Action and PAGA Settlement is GRANTED.

Under California Rules of Court, rule 3.767(b) '[class action] orders may be altered or amended as necessary.' Here, Plaintiffs maintain there are typographical errors and inconsistencies in the papers appended to Plaintiff's Motion for Preliminary Approval and the final approval hearing is on December 1, 2023. Specifically, the Long Form Settlement Agreement, Class Notice and Workweek Dispute form failed to contain the definition of the PAGA period and the correct definition of Workweek and the agreement was unsigned by the parties.

Good cause exists to permit the amendment.

The motion is GRANTED.

The Court will sign the proposed order. (ROA 56.) The final hearing remains set on December 1, 2023, at 10:30 a.m. in Department 70.
